Department of Justice prosecutors are set to file charges against three agents of the Philippine Drug Enforcement Agency and four police officers over the botched buy-bust operation in February 2021 that left four people dead.

“The Panel of Prosecutors determined the facts that both PDEA and [Philippine National Police] where conducting their separate buy-bust operations along Commonwealth Avenue, but the respective informants of the PDEA… and QCPD-DSOU… intertwined the operations of the two agencies,” the DOJ said in a statement on Thursday.

The DOJ said PDEA agents Khee Maricar Rodas. Jeffrey Baguidudol and Jelou Satiniaman will be charged with homicide over the death of P/Cpl. Eric Elvin Garado.

Meanwhile four police officers namely P/Cpl. Paul Christian Gandeza, P/Lt. Honey Sesas, P/Maj. Sandie Caparroso and P/Maj. Caparroso and P/SMSg. Melvin Merida are indicted for direct assault for injuries of PDEA agents.

The DOJ said the charges will be filed before the appropriate Quezon City Regional Trial Court.

The case stemmed from an incident in February 2021 in Commonwealth, Quezon City where agents of PNP and PDEA engaged in a shootout, both claiming they were conducting anti-drug operations.

Two police officers, one PDEA agent and one informant died in the incident.

President Rodrigo Duterte ordered the parallel probes of the two involved agencies to stop, and tapped the National Bureau of Investigation to look into the incident.
